The Discovery Unit handles defense
requests for discovery and collects the fees for this service.
The process is set in motion by a Request for Discovery form,
which may be completed by district attorney personnel or by
private counsel. The forms are available at the District Attorney's
Office main reception counter. Discovery can be mailed or
picked up at the office reception counter unless you are on
the COD list (see "Payment" below). The discovery
unit is open from 8:00 a.m. to 1:00 p.m. However, special
arrangements for discovery may be made by contacting, in advance,
the discovery unit or the deputy district attorney assigned
to the case.
Misdemeanor cases - Initial discovery packets will be available free of charge in the arraignment court. After arraignment, if there is any follow-up information, the fees listed below will be charged to the defense attorney of record.
Felony cases - Initial discovery packets will be available only after the arraignment at our office reception counter or by mail unless C.O.D. for the usual fees. It is not available in advance or in the courtroom. Discovery will be released only to the defense attorney of record. A consecutive number system is used to make it easier for both sides to determine if discovery has been completed.
Fees - Document copying is charged at $.50 per page; copying audiotape and floppy disks at $1.65 per tape; and copying videotape and CDs at $5.00 per tape.
Payment - Defense attorneys for discovery provided their account with the discovery unit is current. If an outstanding balance remains unpaid after one reminder notice is sent, discovery will be provided on a COD basis only, i.e., upon receipt of cash or check.
